These Terms & Conditions apply to all offers, orders, and agreements made through www.veracomfort.co.za.

Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

  • Reflection period: the period during which the consumer may exercise the right of withdrawal.
  • Consumer: a natural person acting outside a business or professional capacity.
  • Day: calendar day.
  • Duration transaction: a distance contract for products or services delivered over time.
  • Durable data carrier: any medium allowing information to be stored and reproduced unchanged.
  • Right of withdrawal: the consumer’s right to cancel the agreement within the reflection period.
  • Entrepreneur: the operator of this website offering products remotely.
  • Distance agreement: an agreement concluded without physical presence of both parties.
  • General Terms and Conditions: these Terms & Conditions.

Article 2 – Identity

Article 3 – Applicability

These Terms & Conditions apply to every offer and distance agreement made through my website.

Before completing an order, these Terms & Conditions are made available electronically and can be stored by the consumer on a durable data carrier.

If any provision of these Terms is found to be invalid, the remaining provisions remain fully in force and will be interpreted in the spirit of these Terms.

Article 4 – The Offer

All offers are non-binding and subject to availability.

Product descriptions and images are provided as accurately as possible. Minor deviations in colour or appearance may occur and do not constitute grounds for compensation or cancellation.

Prices shown exclude customs duties, import taxes, or clearance fees. Any such charges are the responsibility of the customer.

Article 5 – The Agreement

The agreement is concluded once the consumer completes the checkout process and payment is successfully received.

I reserve the right to refuse or cancel an order if there are reasonable grounds to do so, such as suspected fraud or incorrect information.

Article 6 – Right of Withdrawal

Consumers may withdraw from the agreement within 14 days of receiving the product, unless the right of withdrawal is excluded under Article 8.

Returned products must be unused, complete, and — where reasonably possible — in original packaging.

Article 7 – Costs of Withdrawal

Return shipping costs are the responsibility of the consumer.

Refunds are processed within 14 days after receiving the returned product or valid proof of return.

Article 8 – Exclusion of Right of Withdrawal

The right of withdrawal does not apply to:

  • Custom-made or personalised products
  • Products of a hygienic nature once the seal has been broken
  • Products that cannot be returned due to health or safety reasons

This exclusion is clearly stated before purchase.

Article 9 – Prices

Prices remain valid during the stated offer period, except where changes result from legal obligations.

All prices are subject to typographical or pricing errors. I am not obliged to deliver products at an incorrect price caused by such errors.

Article 10 – Conformity & Warranty

Products comply with the agreement and reasonable standards of usability.

Warranty does not apply if:

  • Products are damaged through misuse
  • Products are altered or repaired by third parties
  • Damage results from improper handling

Article 11 – Delivery

Orders are processed with care and delivered to the address provided by the consumer.

If delivery is delayed beyond 30 days, the consumer may cancel the agreement and receive a full refund.

Risk of loss or damage transfers upon delivery to the consumer.

Article 12 – Duration Transactions

Consumers may cancel ongoing agreements at any time, subject to a notice period of no more than one month, unless otherwise stated.

Article 13 – Payment

Payments must be completed during checkout.

Consumers are responsible for providing accurate payment details. In case of non-payment, reasonable recovery costs may be charged where legally permitted.

Article 14 – Complaints

Complaints must be submitted in writing within 7 days of discovery.

I aim to respond within 14 days. If additional time is needed, this will be communicated clearly.

Article 15 – Governing Law

These Terms & Conditions are governed by applicable law, regardless of the consumer’s country of residence.

Article 16 – CESOP

Due to regulatory requirements introduced in 2024, payment service providers may report transaction data to the European CESOP system where legally required.
